Le cas en bref.

Simon est séparé et paie une pension alimentaire pour ses deux adolescentes. Soudainement, son ex-conjointe de fait réclame et obtient des arrérages importants (rétroactivement à plus de 7 années) de frais particuliers en jugement de première instance et ceci sans avoir déposé aucune pièce justificative.  Or le Code Civile du Québec (art. 595) limite à une année la possibilité de réclamer des arrérages de frais particuliers. Pourtant, le juge de première instance accorde 7 ans.

Son avocate porte la cause en appel, laquelle confirme par jugement unanime le jugement de première instance. Pourtant, même s’il s’agit d’un cas relevant de la juridiction provinciale, les juges persistent à appliquer les dispositions qui relèvent d’une autre province et de la loi fédérale sur le divorce. Simon doit maintenant se loger, se nourrir et se transporter avec 266$ bruts par mois. Le reste de ses revenus est saisi pour acquitter les arrérages.

Ceci ouvre un dangereux précédent qui servira de jurisprudence partout au Canada.

1-      On passe outre la loi limitant à un an la rétroactivité des frais particuliers.

2-      On passe outre la jurisprudence de la Cour Suprême de Canada qui limite à 3 ans la rétroactivité sur les frais particuliers.

3-      On applique aux conjoints de fait les dispositions de la loi sur le divorce.

The case in brief.

Simon is separated and pays child support for his two teenage daughters. Suddenly, his ex-wife calls made and received significant arrears (retroactive to over 7 years) specific charges in trial of first instance and this without filing any document proving the expenses. But the Civil Code of Québec (art. 595) limits to one year arrears of special costs that can be claimed . However, the trial judge granted 7 years.

His lawyer bringing the case on appeal, which by unanimous decision confirms the decision of first instance. Yet even if the case is under provincial jurisdiction, judges continue to apply the provisions which come from another province and the federal law on divorce. Simon now has shelter, food and carry it with a gross income of $266 every month. The rest of his income is seized to pay the arrears.

This opens a dangerous precedent that will serve as case law across Canada.

1. It ignores the law limiting to one year retroactive to specific costs.
2. It ignores the decisions of the Supreme Court of Canada that limits to 3-year retrospective on the specific charges.
3. is applied to common-law provisions of the divorce law.

The ruling of the Supreme Court of Canada reported a case very similar to Simon.
